Old industrial installations subject to the EU Directive 96/61/EC of the Council about integrated pollution prevention and control (IPPC directive) must be brought into compliance with the specifications of this EU Directive by not later than 31.10.2007.

Corresponding adjustment measures for installations which are subject to the Emissionsschutzgesetz für Kesselanlagen (EG-K) must be reported to the authority by 31.10.2006 already.  

By bundling measures one wants to achieve on the one hand a high protection level for the environment by protecting air, water and soil, taking into account also waste management, and on the other hand avoid or reduce emissions as much as possible. According to the IPPC directive installations with old operating licences are to be brought up to the latest standard of technology. IPPC installations are installations related to the following categories of industrial activities according to Annex I of the IPPC directive:

  • Energy industries

  • Production and processing of metals

  • Mineral industry

  • Chemical industry

  • Waste management

  • Other industrial activities (e.g. production of pulp, paper and board)

The implementation of the IPPC directive into national law was done in Austria through:

  • Novelle der Gewerbeordnung (GewO)

  • Abfallwirtschaftsgesetz (AWG)

  • Emissionsschutzgesetz für Kesselanlagen (EG-K)

  • Mineralrohstoffgesetz (MinRoG)

Integrated installation assessment

For new IPPC installations an "integrated installation licence" is required, which covers all environmental areas. "Integrated installation licence" means that all aspects of an installation, which can affect the environment, must be taken into consideration during the licensing procedure, for example pollution of air, water and soil, waste generation, use of raw materials, energy efficiency, noise, accident prevention, risk management etc.

The application for the approval of a new IPPC installation must contain the following details:

  • Substances and energy used or generated in the installation  

  • Description of the conditions of the site of the installation

  • Sources of emissions from the installation  

  • Type and quantity of foreseeable emissions from the installation into each environmental medium

  • Major effects of emissions on the environment to be expected

  • Measures for monitoring emissions

  • Measures for preventing or, where this is not possible, reducing emissions

  • Preventive measures against environmental pollution, for the avoidance of accidents and damage control as well as measures in connection with the discontinuation of an installation  

Adjustment to "best available techniques"

The licensing of installations is to be made according the latest standard of technology and based on the "best available techniques" – BAT ("beste verfügbare Techniken" (BVT). The emission limit values in license notifications must also be oriented on these techniques. The following criteria must be observed for assessing the best available techniques:

  • Use of low-waste technology

  • Use of less dangerous substances

  • Reclamation and recycling of all substances and waste

  • Progress in technology and in scientific discoveries

  • Effects and quantities of the respective types of emissions

  • Use of raw materials (incl. water) and energy efficiency

  • Overall effect of emissions and dangers for the environment

  • Accident prevention and reduction of environmental consequences

  • BAT-reference documents (BREF)

Time limit for the adjustment of old IPPC installations

The time limit for the adjustment to the state-of-the-art (BAT) is 31.10.2007. An installation is considered as old if it was legally licensed before the end of 31 October 1999. For old IPPC installations an integrated installation assessment has to be made - in analogy to the criteria for the licensing of a new IPPC installation - and all suitable measures for the adjustment to the state-of-the-art according to BAT must be implemented by not later than 31.10.2007. The obligation lies with the respective owner of an old installation. If there is need for adjustments of old installations, a modification approval from or a modification notice to the authority is required, depending on the scope of the modification.
